1. Agreement to Terms

By accessing or using Limita (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including workspace administrators and team members using the Limita Power-Up for Trello or other supported platforms.

2. Description of Service

Limita is a time tracking and project estimation tool that integrates with project management platforms like Trello. The Service provides:

  • Real-time timer functionality for tracking work on cards
  • Manual time entry and historical time range management
  • Project estimates and custom field tracking
  • Time tracking reports and analytics
  • Multi-member collaboration with workspace-level data isolation
  • Billable hours tracking and client management
  • WebSocket-based real-time synchronization across team members

3. Account Registration and Access

3.1 Trello Integration

Access to Limita requires a valid Trello account. By using our Service, you authorize us to access your Trello data as described in our Privacy Policy. You are responsible for maintaining the security of your Trello account credentials.

3.2 Workspace Administration

Workspace administrators have additional privileges including:

  • Managing subscriptions and billing
  • Configuring custom fields and workspace settings
  • Managing OAuth connections
  • Managing clients for billable hours tracking

4. Subscription and Billing

4.1 Free Trial and Read-Only Access

Users without an active subscription have read-only access to existing data but cannot create new timers, time ranges, or estimates.

4.2 Paid Subscriptions

Paid subscriptions are available on monthly or annual billing cycles. Pricing is per workspace and includes unlimited team members.

4.3 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.4 Refunds

Refunds are handled on a case-by-case basis. Please contact [email protected] to request a refund.

4.5 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation, you retain access until the end of your current billing period, after which your account reverts to read-only access.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to our systems or other users' data
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or abuse our API beyond rate limits (1000 req/sec per IP, 100 req/sec per member)
  • Reverse engineer or decompile any part of the Service
  • Resell or redistribute the Service without permission

6. Data Ownership and Privacy

6.1 Your Data

You retain all rights to your time tracking data, estimates, and other content you create using the Service. By using Limita, you grant us a license to store, process, and display this data as necessary to provide the Service.

6.2 Data Isolation

We use PostgreSQL Row-Level Security (RLS) to ensure workspace data is isolated and only accessible to authorized members of that workspace.

6.3 Privacy

Our use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Service Availability and Support

7.1 Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

7.2 Support

Email support is available at [email protected]. We aim to respond within 48 business hours.

7.3 Monitoring

We use Sentry (EU region) for error tracking and PagerDuty (EU region) for incident management to ensure service reliability.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Limita and is protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

9. Third-Party Services

The Service integrates with and depends on third-party services:

  • Trello: For accessing board and card data
  • Stripe: For payment processing
  • Cloudflare: For DNS and CDN services
  • Hetzner: For hosting infrastructure

We are not responsible for the availability or functionality of these third-party services. Your use of Trello is subject to Trello's terms of service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMITA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Limita and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason including:

  • Breach of these Terms
  • Non-payment of subscription fees
  • Fraudulent or illegal activity
  • At our sole discretion

Upon termination, your data will be retained for 90 days and then permanently deleted unless required by law to retain it longer.

14. Data Export

You can export your time tracking data at any time directly from the Timesheet tool within the application. Data is available in CSV format for easy import into other tools or spreadsheets.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Germany.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Limita regarding the Service and supersede all prior agreements and understandings.
